Terms of Use

Please take a moment to carefully read these Terms of Use, which form a binding agreement between you and us, Meltinpop Ltd., a company in incorporation under the laws of the State of Israel, relating to use of the services offered on the www.meltinpop.com website, as well as other services, features, content, applications or widgets offered by us or our partners, now existing or subsequently developed (collectively “Meltinpop”).

1. Limitations on eligibility

You may not use Meltinpop if you do not agree to the Terms of Service; if you are not permitted to accept the terms under any applicable law, regulation or obligation; if you are not of legal age to form a binding contract; or if you are under 13 years of age.

2. Use of Meltinpop generally

Meltinpop is a new, fun way to socially explore the culture around you.

Your use of Meltinpop as permitted is solely for your personal, noncommercial use. In addition, if you are a content creator, such as a musician, writer, director, etc, and you want to expose your works, their meanings and influences, as well as connect with friends, users and fans, you are invited. Other non-personal or commercial use of Meltinpop is permitted only with our prior written consent.

You may not access Meltinpop using a different interface than the interface we provide, including, without limitation, by means of data crawling, screen scraping, robots, or similar data gathering and extraction tools. You may not decipher, decompile, disassemble, reverse engineer or otherwise attempt to derive any source code or underlying algorithms of any part of Meltinpop, directly or indirectly, except to the limited extent that applicable laws specifically prohibit such restriction.

You will not circumvent, disable, disrupt or otherwise interfere with any feature of Meltinpop or alter or modify any part of Meltinpop other than as may be reasonably necessary to use Meltinpop for its intended purpose.

3. Registration information

In order to access some features of Meltinpop, you will have to create an account. You may never use another person's account without permission. Your Meltinpop account is based on the permission you are giving Meltinpop to use your access credentials in other services (such as Facebook Connect). To use Meltinpop you need to make sure that password to those services remains secure and that the information provided to such services is real (real name and picture).

4. Meltinpop content

The content of Meltinpop (including, without limitation, text, software, scripts, graphics, photos, sounds, music, videos, animations, designs, user interface) and the trademarks, service marks and logos contained therein, are owned or licensed in by us. We reserve all rights to Meltinpop except for the permissions expressly contained in these Terms of Use. We distribute and publish content supplied by third parties. We have no control over such content and assume no responsibility with respect to such content. If your rights have been infringed, please see our reporting procedures in section ‎9 below.

5. Your submissions

Meltinpop is supposed to be used to help people, such as you and your friends, find the meaning of digital content ( music, books, movies, tv, etc) – or the other way around - search for digital content dealing with certain meanings. Everyone can see what you contribute, so by participating in a meltinpop you help people discover about stuff you care about – even as they search for it on Google, Yahoo, Bing or other search engines.

Meltinpop allows you to submit, post or make available content to Meltinpop. When you choose to do that, it means that you are allowing everyone, including people outside of Meltinpop and automated services such as search engines, to access and use that information, to associate it with you (i.e., your name and profile picture) and to import, export or distribute it without privacy limitations. Such information may also be made available, including your name and profile picture, even outside of Meltinpop, such as on public search engines.

You retain your rights in content which you submit, post or make available on Meltinpop. However, by submitting, posting or displaying such content you give us a perpetual, irrevocable, non-exclusive, worldwide, transferable, sublicenseable, royalty-free and fully paid-up license to distribute, publicly display, reproduce, adapt, modify, translate, create derivative works, publish and publicly perform any such content in connection with Meltinpop and our (and our successors’ and assigns’) business, in any media format or channel. Please note that this license will remain effective even if you terminate your account in Meltinpop (e.g. if you revoke Meltinpop access to your Facebook credentials). You represent and warrant to us that you have all right, power and authority necessary to grant the above license.

You may not submit, post or make available to us any content that is unlawful, harmful, abusive, defamatory, vulgar, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable. We retain the right to remove any and all content submitted to the site with or without notice or cause.

6. No Warranty

MELTINPOP AND ITS CONTENT ARE PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. YOUR USE OF MELTINPOP IS AT YOUR OWN RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE, OUR OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH MELTINPOP AND YOUR USE THEREOF. WE MAKE NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY OR COMPLETENESS OF MELTINPOP CONTENT AND ASSUMES NO LIABILITY OR RESPONSIBILITY FOR ANY (I) ERRORS, MISTAKES, OMISSIONS OR INACCURACIES IN MELTINPOP OR ANY RELIANCE ON THE CONTENT, (III) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN, (IV) ANY CHANGE, INTERRUPTION OR CESSATION OF MELTINPOP, TEMPORARY OR PERMANENT, (V) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE WHICH MAY BE TRANSMITTED TO OR THROUGH MELTINPOP BY ANY THIRD PARTY. WE DO NOT WARRANT, ENDORSE, GUARANTEE, OR ASSUME RESPONSIBILITY FOR ANY PRODUCT OR SERVICE ADVERTISED OR OFFERED BY A THIRD PARTY THROUGH MELTINPOP OR ANY LINKED WEBSITE OR FEATURED IN ANY BANNER OR OTHER ADVERTISING, AND WE WILL NOT BE A PARTY TO OR IN ANY WAY BE RESPONSIBLE FOR MONITORING ANY TRANSACTION BETWEEN YOU AND THIRD-PARTY PROVIDERS OF PRODUCTS OR SERVICES.

7. Limitation of Liability

IN NO EVENT WILL WE OR OUR OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE ARE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE FOREGOING LIMITATION OF LIABILITY SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW IN THE APPLICABLE JURISDICTION. WE WILL NOT BE LIABLE FOR USER SUBMISSIONS OR THE DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF ANY THIRD PARTY AND THAT THE RISK OF HARM OR DAMAGE FROM THE FOREGOING RESTS ENTIRELY WITH YOU.

Meltinpop is controlled and offered by us from our facilities in Israel. We make no representations that Meltinpop is appropriate or available for use in other locations. Those who access or use Meltinpop from other jurisdictions do so at their own volition and are responsible for compliance with local law, and consent to the transfer of their information for processing in the jurisdictions where the servers of Meltinpop may be located.
